Work Product Review and Consultation Services 

Dr. Rybicki is available to assist you and your client with several forms of consultation. One of the primary methods is through a Work Product Review. This may include reviews of documents such as psychological assessments, domestic violence and substance abuse assessments, guardian ad litem and parenting plan evaluations, and other forms of evaluation by other professionals. 

The review of documents may lead to a written report, declaration, and possible testimony. There are three groups of common results of a Work Product Review.

If the review of the methods, logic, and analysis determines that the work was at least reasonably adequate, that may be the end of the process. About a third of the cases fall within that group while about a third are mixed (strengths and weaknesses) and about a third are more significantly inferior due to errors and omissions. That last group should be given minimal weight. Reports and testimony about such outcomes can impact your case. 

It should be understood that Work Product Reviews do not provide a "second opinion" or diagnose in absentia. They provide the Court with a specialized assessment of the weight to give to the work done by others. In some cases the testimony may expand to addressing relevant research, clinical practice, and issues of significance especially when considered using questions addressing hypothetical features.

In some cases, there will be a choice to skip providing testimony or a report and to focus instead on generating useful material for cross-examination or deposition of the opposing experts.

Other forms of consultation may be as a general topic rebuttal witness seeking to educate the Court about research and findings in the field. It is possible that Dr. Rybicki can work closely with you to consider trial strategy and possible areas of strength and weakness in your case. On the basis of this assistance, you may find ways to optimize your case presentation and enlist the help of other experts.

There are times when you may wish to call Dr. Rybicki as an expert witness to help inform the court of these issues. Much of this work can now be done remotely using current technology. That is a significant savings in both time and money to you and your client.

Dr. Rybicki can also help prepare rebuttal witness testimony, presenting important information from the research and clinical literature, and in some cases, offering additional data that has been overlooked by the opposing expert. Dr. Rybicki can assist in jury selection and trial strategy, and offer useful and piercing questions for depositions and cross-examination of opposing counsel witnesses.
